Article 1: General provisions

The e-commerce website of Mamsy with registered office at Diepenbeek, Nieuwstraat 203, Belgium, BE 0773221840, (hereinafter 'Mamsy') offers its customers the opportunity to purchase the products from its webshop online.

These General Terms and Conditions ("Terms") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order through Mamsy's web shop, the Customer must explicitly accept these Conditions, thereby agreeing to the applicability of these Conditions, to the exclusion of all other conditions. Additional conditions of the Customer are excluded, unless they have been accepted by Mamsy in advance, in writing and expressly.

Article 2: Price

All stated prices are expressed in EURO, always including VAT and all other duties or taxes that are obligatory to be borne by the Customer.

If delivery, reservation or administrative costs are charged, this will be stated separately.

The indication of price only refers to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalog and e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer are not binding for Mamsy. As far as the accuracy and completeness of the information provided, Mamsy is only bound by an obligation of means. Mamsy is under no circumstances liable in the event of manifest material errors, typesetting or printing errors.

If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we request the Customer to contact our customer service in advance.

The offer is always valid while stocks last and can be adjusted or withdrawn by Mamsy at any time. Mamsy cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

Article 4: Online purchasing procedure

1 * Create account
When you make a purchase in our webshop for the first time, you need to create an account. At the top of the homepage you can choose "Register". Then enter your email address and click on "Create your account". Enter your personal details and select "Register" at the bottom. Congratulations, You are now registered and can place orders online.

2 * Make your choices in our online catalog:
You can now search for your favorite pair in our online catalog. Before adding the article to your shopping basket, choose the correct size. An overview is given in "Order Summary". You can of course also continue shopping, click on "Continue shopping".
3 * Complete purchase:
Check the delivery veins and billing address before continuing. Read the "general terms and conditions of sale" and find them if you agree and want to proceed. You can see that you can now choose a payment method. We only work with Mollie to pay 100% safely. You click on the link and see that you go to a secured page of Mollie. Here you can choose from VISA, Mastercard, Bancontact, ING Home Pay, Belfius, KBC Online, Ideal, Paypal and Bitcoin. Now follow the payment instructions from Mollie to complete your payment.
4 * Congratulations on your purchase:
As soon as the payment has been accepted, you will receive a confirmation of your purchase by email.

Mamsy is entitled to refuse an order due to a serious shortcoming of the Customer with regard to orders in which the Customer is involved.

Article 5: Delivery and execution of the agreement

The ordered items are shipped free of charge within 1-2 working days via Bpost in Belgium and to the Netherlands and France.

Unless otherwise agreed or expressly stated otherwise, the goods are delivered to the Customer's residence within 30 days of receipt of the order.

Any visible damage and / or qualitative shortcoming of an article or other shortcoming in delivery must be reported immediately by the Customer to Mamsy via Email address Retour@mamsy.be.

The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods. However, the risk will already pass to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by Mamsy.

Article 6: Retention of title
The delivered items remain the exclusive property of Mamsy until full payment by the Customer.
The Customer undertakes, if necessary, to inform third parties of the retention of title of Mamsy, for example to anyone who would seize the articles not yet fully paid for.

Article 7: Right of withdrawal

The provisions of this article only apply to Customers who, in their capacity as consumers, purchase articles online from Mamsy.

The Customer has the right to withdraw from the agreement within 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, physically takes possession of the last good. ";

To exercise the right of withdrawal, the Customer must inform Mamsy, Nieuwstraat 203, 3590 Diepenbeek, Belgium of his decision to withdraw from the agreement by e-mail by e-mail return@mamsy.be. The Customer can use the attached model withdrawal form for this, but is not obliged to do so.

To meet the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to Bpost immediately, but in any case no later than 14 calendar days after the day on which he has notified Mamsy of his decision to withdraw from the agreement, via 1 of their branches. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

Mamsy will bear the cost of returning the goods.]

If the returned product is in any way reduced in value, Mamsy reserves the right to hold the Customer liable and claim compensation for any depreciation of the goods resulting from the use of the goods by the Customer that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

If the Customer cancels the agreement, Mamsy will pay all up to that point

Article 8: Warranty

Pursuant to the law of September 21, 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must contact customer service and return the item to Mamsy at his expense.

When a defect is established, the Customer must inform Mamsy as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after it has been established. Afterwards, any right to repair or replacement lapses.

The (commercial and / or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or changes to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable, delivery, are deemed not to be hidden defects, unless the Customer proves otherwise.

Article 10: Penalties for non-payment

Without prejudice to the exercise of other rights held by Mamsy, the Customer owes interest of 10% per year on the unpaid amount in the event of non-payment or late payment from the date of the default and without notice. In addition, the Customer is legally obliged to pay a fixed compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.

The customer is responsible for keeping his login details confidential and for the use of his password. Your password is stored encrypted, so Mamsy has no access to your password.

Article 12: Use of cookies

These Conditions are supplemented by other conditions that are explicitly referred to, and the general sales conditions of Mamsy. In the event of a conflict, these Terms and Conditions will prevail.

The Customer accepts that electronic communications and backups can serve as evidence.


Article 16: Applicable law - Disputes

Belgian law is applicable, with the exception of the provisions of private international law regarding applicable law.

The courts of the Consumer's place of residence have jurisdiction in legal disputes. The Consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
